			<content:encoded><![CDATA[<p>ICANN has today approved an expansion of the top level Internet domains from the familiar ones (.com, .net, .org, etc) to an unlimited array of choices.  All that will be required is a showing of technical ability to manage the requested domains.  Details are currently sketchy regarding the application process, it appears that ICANN has yet to approve the final implementation steps. <p><strong>Cyberlaw Central Commentary</strong><br />
These are good tips and may make people more careful when online.  For example, people on Twitter commonly post details about where they are *now*, which may not be the house or other areas you may not want the masses to know are unwatched.  Certainly something to think about as we become so interconnected and online.  Apple&#8217;s new version of .mac is entitled &#8220;Mobile Me&#8221; for a reason - it&#8217;s a tool for people to use and stay synchronized across devices as their lives go increasingly &#8220;into the cloud.&#8221;  We just need to be careful and consciously choose what we make public as we use these networked tools.</p>

			<content:encoded><![CDATA[<p>Over lunch today, I had a nice chat with a fellow lawyer about digital rights management (DRM), among other topics.  Then, later on, I came across this nice article from The Guardian entitled &#8220;<a href="http://www.guardian.co.uk/technology/2008/may/15/drm.apple">How Apple is Changing DRM</a>.&#8221;</p>
<p>DRM is a way for copyright owners to get around the rights the purchaser of a copy of a physical item would ordinarily have. These rights come from the &#8220;first sale doctrine&#8221;, whereby once the physical item is sold the copyright owner has no more control over what the purchaser does with the physical item.   For example, if you purchase a book, you can tear it from its binding and put it into a 3-ring binder, or make paper airplanes, etc.  DRM doesn&#8217;t let you do certain things with electronic media, such as put it on non-authorized hardware.  Breaking the DRM usually means that you&#8217;re in violation of the Digital Millennium Copyright Act&#8217;s anti-circumvention provisions.  But, as the article points out, DRM doesn&#8217;t really stop piracy, it just frustrates users.</p>
<p>The trend is now to eliminate DRM from many files, but as the article points out Apple is less likely to get rid of it.  The article&#8217;s headline is a little misleading, it&#8217;s really more about what Apple&#8217;s competitors are doing rather than what Apple is doing.</p>
<p>I&#8217;m interested to hear what you as users find to be the most oppressive DRM in your ordinary use of your computers and media devices.  The comments are open.</p>

			<content:encoded><![CDATA[<p>The results of the FCC&#8217;s wireless spectrum auction are of particular interest to more than just  people in the telecom industry, as it will significantly impact how people access the Internet for years to come.</p>
<p>It&#8217;s no big surprise that Verizon is the big winner, but I especially enjoyed reading <a href="http://scrawford.net/blog/why-block-c-matters/1136/">Susan Crawford&#8217;s analysis of the issue of what Verizon will do with it entitled &#8220;Why Block C Matters.</a>&#8221;  Susan is an ICANN board member, as well as a law professor at Cardozo Law School.  I agree with her that it confirms the existing business model of handheld devices being used to access the Internet.  </p>
<p>It also means that we&#8217;re going to have to deal with Verizon&#8217;s dominance in this segment of the market.</p>
<p>It also means that we&#8217;re going to have less options for wireless access than we otherwise would have had if others would&#8217;ve won the bidding.</p>
<p>It also means that we&#8217;re going to have a company who can bring market pressures to bear to discriminate against other carriers, all while promising in public to have an &#8220;open&#8221; network.</p>
<p>I wonder if we will someday look back on this day as the day in which the wireless Internet changed.</p>

			<content:encoded><![CDATA[<p>Since my last post, yesterday I attended the end of the Day 1 sessions and the evening Techshow After Dark event.  Today, I attended sessions on e-discovery, disaster planning, using Internet-based collaboration tools, and computer forensics.  </p>
<p>The last one was fun, <a href="http://www.craigball.com/about.html">Craig Ball</a> was looking for a volunteer for someone to give him a USB drive that he would forensically analyze.  I gave him one of mine that I was pretty sure was uninteresting, and was relieved to see that was the case after Craig was done.  Overall, a good session.</p>
<p>I also enjoyed <a href="http://www.inter-alia.net">Tom Mighell</a> and <a href="http://www.denniskennedy.com">Dennis Kennedy</a>&#8217;s talk on the collaboration tools.  <a href="http://www.abanet.org/abastore/index.cfm?section=main&#038;fm=Product.AddToCart&#038;pid=5110589">They&#8217;ve written a book on it, which I encourage you to check out</a>.</p>

			<content:encoded><![CDATA[<p>The &#8220;Laptop Lanes&#8221; are finally in place here at Techshow 2008, so I am posting this later than planned. <p>Other sessions I have attended include records management, document management, and law firm data breaches.  The last one is a personal favorite of mine, <a href="http://www.thorpreed.com/html/index.html">Dave Ries</a> and <a href="http://www.senseient.com/">John Simek</a> always do a great job putting this one together.  In past years they&#8217;ve had live demos of intrusions in process, but the hypos this year were esoteric enough to make real examples unwieldy.</p>
<p>I&#8217;m back off now to the expo hall, looking forward to the afternoon and evening sessions.</p>
