This week, I liked Cathy Gellis’ new article on the government censorship inherent in the DMCA as it is currently written. A recent 5th Circuit decision on copyright damages is being requested for rehearing en banc over whether the statutory damages should have been assessed per song, as opposed to per album. Finally, I liked Mike Masnick’s analysis of why copyright is not the right regime for considering whether there is a cause of action for training an AI model.
